This might be a bit on the crazy side, but what if Osborn says that Iron Patriot is Stark - or that's what he wants the public to believe, to give his team "credibility." In reality it might be someone else.
At this point the public just hates Tony and anything Stark-related, so I don't think Osborn would say it's Stark to give the team any street cred. In fact, I can see him trying to take advantage of the fact that the public hates Stark tech right now and push his stuff, saying that the Iron Patriot is using OsArmour or whatever Nicktem said it was. I don't know why they'd make it look like Iron Man, though. If he's trying to separate his stuff from Stark's, you think he'd come up with a different design.
I just see the inevitable showdown between Osborn's and Stark's tech, and I believe that -- even with Marvel hating on Tony/IM now -- Stark will win out in that war.
